Dear Homeowners,

Your attention is invited to Eagle City Ordinance, Sect 9.28.060, Removal of Snow,

This Ordinance is quoted below:

Shoveling of public sidewalks is required. It shall be unlawful for any owner or occupant of any lot, block, or parcel of real property within the City, or any agent in charge of such property, to allow any snow or ice to accumulate or remain upon the entire width of any sidewalk in the public right-of-way abutting such property longer than 24 hours from the time of the last accumulation of such snow or ice.  Depositing snow in the right-of-way is prohibited.  IT SHALL BE UNLAWFUL FOR ANY PERSON TO REMOVE SNOW OR ICE FROM ANY PRIVATE PROPERTY OR PUBLIC SIDEWALK AND DEPOSIT SUCH SNOW OR ICE UPON ANY PUBLIC STREET, SIDEWALK, ALLY, OR OTHER PUBLIC PROPERTY WITHIN THE CITY.  IT SHALL BE UNLAWFUL FOR ANY PERSON TO PLOW, SHOVEL, BLOW OR OTHERWISE MOVE SNOW OR ICE IN OR UPON ANY PUBLIC STREET, SIDEWALK, ALLEY OR OTHER PUBLIC PROPERTY WITHIN THE THE CITY IN A MANNER WHICH: 1. Obstructs vehicle or pedestrian traffic upon the public right-of-way; 2. Increases hazards to vehicles and pedestrians traveling upon the public right-of-way; 3. Interferes with the maintenance of the public right-of-way by the city; or 4. Obstructs clear vision at intersections.

It should also be noted that shoveling snow or ice into streets has the potential of clogging street gutters and plugging storm drains which can result in the flooding of our streets.

Homeowners living near street storm drains are encouraged to clear snow, ice, and debris from the drains to allow water and snow melt to drain and preclude street flooding.

On behalf of the Banbury Meadow Community, the Board appreciates your compliance with the Eagle City Ordinance and guidance provided above.

Thank you.

Board of Directors, BBM HOA
